"Woman wants complaint filed against Marzilli; Seeks assault, battery charges for alleged April encounter" by Andrea Estes, Globe Staff | June 17, 2008

An Arlington woman who said she was groped by state Senator James Marzilli in April took the unusual step yesterday of asking a court magistrate to issue a criminal complaint against the senator.

The woman's request for indecent assault and battery charges could renew questions about why Middlesex District Attorney Gerard T. Leone Jr. decided not to pursue the woman's original charges against Marzilli, which she lodged with Arlington police.

At the time he dropped the case, Leone said that there was not enough evidence. Three weeks after Leone made that determination, however, Marzilli was accused of grabbing a woman he saw on a bench in downtown Lowell and harrassing another. Charges in the Lowell cases are pending, and other women have since stepped forward with similar allegations.

Wendy Murphy, the Arlington woman's lawyer, said her client decided to ask a Cambridge District Court magistration to level charges after Marzilli refused her request for an apology.

"It's a little late in the game for an apology to be sufficient, yet that is all she's asked for," Murphy said.

"This is the only legal option at this point," she said. "For someone who wants nothing more than an apology and a little bit of justice, she's not asking for much."

Marzilli has denied all of the charges filed against him, including those made by the Arlington woman. The senator - who has checked into McLean Hospital and was still there yesterday, according to his lawyer - has said he would not run for reelection this year but would serve out his term.

A graphic account of the alleged incident in the Arlington woman's apartment on April 6 was filed yesterday along with her request for the complaint. She said in the account that the assault took place after Marzilli gave her a ride home from a charity event.

Marzilli told her at the event that she had been drinking wine and was "in no condition to drive," her complaint said. He asked to come into her apartment and see her recently renovated kitchen, the statement said.

While in the kitchen at about 1 a.m., she said, he "lurched" at her, "grabbed, and began to fondle her breast."

Smooth move, sickie!!!!

"Stunned, the victim asked what he was doing and wondered aloud why he would want to ruin his career," the statement said. "Mr. Marzilli then assaulted the victim again, grabbing her genital area," the statement said.

The statement, filed in Cambridge court, said that, "distraught and traumatized," the woman called the Arlington police, who advised her to go to the hospital, where she was treated and discharged.

Corey Welford, Leone's spokesman, said yesterday that unless there is new evidence, the district attorney will not prosecute the case, even if the magistrate issues the complaint.

My first reaction these days is, "All right, who are they PERSECUTING now and WHY?"

What AGENDA is being PUSHED and what AGENDAS are being COVERED UP!

Prosecutors reexamined the Arlington case after the Lowell charges, he said, but still found insufficient evidence.

"This application for a criminal complaint is being filed without full knowledge of the information that was developed during our five-week investigation into the allegations," Welford said. "The fact is, the legal and factual deficiencies in this case still exist."

At a hearing scheduled for June 30, the Arlington woman will have to show cause why the case should go forward, offering her version of what happened. According to several lawyers, it is rare for private citizens, not police, to seek criminal complaints.

Translation: The government DOESN'T WANT to be BOTHERED WITH IT!

"An individual can do it, but . . . clerks would be hesitant to move forward if made aware of the fact that the matter has been investigated by a DA's office and they've declined to act on it," said Philip A. Tracy Jr., a defense lawyer.

She will not have to prove her case beyond a reasonable doubt, as she would at a criminal trial, but only that a crime probably occurred, lawyers said. If a magistrate finds in her favor, Leone would either have to ignore the magistrate or prosecute a case he already decided not to pursue, lawyers said.

Terrence Kennedy, Marzilli's lawyer, said Leone investigated the allegations and found nothing to them.

"Gerry Leone is probably one of the most law-and-order DAs in the country, let alone the state," said Kennedy. "He's conducted an extensive and detailed investigation that involved a great number of interviews and a review of all the information and made a determination not to prosecute. The case hasn't changed at all."

In the woman's statement, she said that, a few days after the alleged attack, a private investigator visited the woman and urged her to drop the charges.

Oh, so some INTIMIDATING MUSCLE was applied, huh?

The private investigator "told her that the defense investigation of her background would be very painful." the statement said. The investigator said Marzilli was sorry and wanted to offer something "to make this go away," the statement said.

Which means he ADMITS GUILT even if he is PLEADING INNOCENCE!

The woman, who viewed the offer as a bribery attempt, reported it to Arlington police, the statement said.

Kennedy acknowledged that he sent a private investigator to talk to the woman, but he called the bribery charge "a complete lie."

"We were trying to find out what she was looking for, why she was doing this," Kennedy said. "That wasn't the senator sending anyone over with a bribe."

Then, WHAT WERE YOU DOING HARASSING the lady and QUESTIONING HER MOTIVES?

I guess SOME PERVERTS are more equal than OTHER PERVERTS, huh?
