The Only Conspiracy That Matters

Caught my eye as I scanned the N.Y. Times:

"War vs. Terrorism Debate in Embassy Bomb Appeal" by BENJAMIN WEISER

Prosecutors proved that he was a member of Mr. bin Laden’s global conspiracy to kill Americans wherever they could be found.

It was that case, Mr. El-Hage’s conviction for conspiracy to kill Americans, that seemed to provoke the most questions from Judge Jon O. Newman, a member of the three-judge panel hearing the case for the United States Court of Appeals for the Second Circuit.

Judge Newman, at one point, asked a prosecutor why, if there was evidence only that Mr. El-Hage joined a conspiracy to, in effect, wage war against the United States:

Is he any different than any German soldier in World War II who joined what could be called a conspiracy to kill Americans?

Leslie C. Brown, an assistant United States attorney, replied:

Because this was a terrorist conspiracy, your honor.

Translation:

The United States government arbitrarily decides what is and is not "terrorism" and "conspiracies!"
