CIA Tapes Case to Go Away and Disappear

The judge doesn't want any part of it.

WASHINGTON — A federal judge appeared reluctant Friday to investigate the destruction of CIA interrogation videotapes, saying the Justice Department is conducting its own inquiry.

Lawyer Joseph Hunt, representing the White House, told the judge that the tapes destroyed by the CIA had no bearing on the Yemeni men:

"It is inconceivable that the destroyed tapes could have been about abuse, mistreatment or torture of detainees at Guantanamo Bay."

INCONCEIVABLE, huh, you LYING FUCKING FASCIST?


Hunt also asked the judge to refrain from conducting his own investigation because it could influence the inquiry underway by the Justice Department and CIA inspector general.

I am tired of government lies and excuses, readers. I really am.

U.S. District Judge Henry H. Kennedy Jr. said that destruction of evidence would constitute a crime, and that he was not an investigating magistrate such as those in France who are charged with conducting inquiries into criminal activity.

Kennedy asked: "Why should the court not permit the Department of Justice to do just that? It is a law enforcement agency of this country."

So WHO got to the judge, and WTF is he talking about?!

Justice now exists to PROTECT the Bush administration.

Where has this judge been for the last seven years?

David H. Remes, a lawyer for the Yemeni men, questioned why the court should trust the Justice Department, which may have been aware of the destruction of the CIA tapes, to now determine whether other Guantanamo-related evidence is being properly preserved:

"We now have the Justice Department saying stay out of it, we'll figure it out. I must say... this is like leaving the fox in charge of the henhouse."

WASHINGTON — A federal judge said Friday that he would not rule immediately on whether to hold a judicial inquiry into the destruction of C.I.A. videotapes that showed the harsh interrogation of two suspected operatives of Al Qaeda.

After hearing arguments, a United States district judge, Henry H. Kennedy Jr., said that he would take the matter “under advisement” and that he would rule later.

Joseph Hunt, a Justice Department lawyer, said at the hearing that the government inquiry being conducted jointly with the C.I.A’s inspector general would seek to establish whether the government violated any court order to preserve evidence. Mr. Hunt said the government would inform the judge if the investigation finds that a court order was violated.

Yeah, we'll tell you if we violated the law, judge! Good God!

Hey, next time, I get to INVESTIGATE MYSELF for any alleged crimes, right?

If you follow this logic, then any criminal gets to investigate himself to see if he broke the law, then report it to the authorities!

So he'll just tell the authorities that no laws were broken, right?

And if he did break the law, well, he should get retro-active immunity from the government like the spying telecoms, right?

Mr. Hunt said the detainees’ lawyers had failed to show that their clients were covered by that order because the two detainees depicted on the tapes, Abu Zubaydah and Abd al-Rahim al Nashiri, were not at Guantánamo in 2005 and the tapes, recorded in 2002, were not made there.

Yeah, WHERE the TORTURE took place is the TECHNICALITY they will get off on!

Indeed, the government lawyer said that Mr. Remes failed to show that Judge Kennedy’s order, calling for the preservation of documents concerning the “torture, treatment and abuse” of Guantánamo prisoners, addresses any incident involving his clients."

Yup, this CRIMINAL TRANSGRESSION by the Bush White House will again amount to NOTHING!
