"DHS Secretary Michael Chertoff and Dorit Beinisch, president of Israel’s Supreme Court, came together at the conservative Heritage Foundation on Wednesday to discuss ways to change the law to meet the unique security issues of the 21st century.
The United States and Israel face a similar dilemma: how to protect civil rights, even those of your most vicious and unrepentant enemies, in times of peril.

Part of the solution, Chertoff said, is to recognize that some traditional ways of doing things, in intelligence gathering for example, no longer apply in the rapidly changing world, and the public and their leaders should be flexible enough to recognize this and strike an appropriate balance between protection of the public and civil rights.

The United States is in a stage of the country’s legal development in which it suffers from a “lack of clarity” in what rules should govern that balance, said Chertoff, a former judge on the U.S. Court of Appeals for the 3rd Circuit.
A number of factors are contributing to the confusion, he said. First, the traditional legal model that relies on criminal law as a deterrent and mode of retribution does not work when applied to terrorists, because terrorists don’t care about preserving their own lives, Chertoff said.
In addition, technology is changing so rapidly that it is outpacing the government’s legal structures....Whatever is decided, the issue must be addressed head on, with an understanding that there could be costs one way or the other, and that those costs, once agreed to, must be lived with....
Chertoff brought up the congressional debate over the Foreign Intelligence Surveillance Act (PL 95-511) proposals to give immunity to telecommunication companies that provided the government with access to their databases after Sept. 11, 2001.
The companies, which acted in good faith, Chertoff said, are not being protected after the fact by the nation’s leaders, whose determination to keep their promises to the companies seems to fade the further 9/11 recedes from their memories....

“We have to defend the people doing the real work to protect us,” Beinisch said.
Israel has perhaps the most experience of any other Western-style democracy in contemplating issues of counterterrorism and civil rights.
The country, which celebrates its 60th anniversary later this month, is threatened almost daily with rocket fire and suicide bombers. And yet it extends civil liberties, such as the right to judicial review and applications of the Geneva Conventions, not only to its own citizens, but also to those accused of carrying out attacks against it — an attitude toward justice that many of its neighbors neither praise nor emulate, Chertoff noted.

Beinisch said Israel’s Supreme Court examines whether the government’s actions are reasonable and meet the principle of proportionality. For example, on the controversial issue of building a security fence in the West Bank, the court takes the view that the fence is necessary for security and thus meets those criteria, although the International Court of Justice has disagreed.
However, Israel’s Supreme Court has ruled in favor of Arab settlers and non-governmental organizations on positioning the fence to avoid excessive restrictions on property rights and freedom of movement, Beinisch said.
In cases of detentions and arrests, the court has ruled on the rights of detainees to access to legal counsel and has upheld the Geneva Conventions on their treatment, even deciding to compensate the victims in some cases, she said.
“It is the duty of the judiciary that a nation fighting for its survival will not sacrifice those things which make the fight worthwhile,” Beinisch said."
