EVERETT - Aspiring artist Quentin Wanham never imagined that some yellow scribbles on his pants would land him in the principal's office at Everett High School for questioning, with a police officer monitoring the interview. The 17-year-old senior was asked about a 6-inch-long logo, known as a graffiti tag, on his pants.

The trip to the office was equally alarming to Wanham's horrified mother, who said she learned of it only afterward from her son. Lorraine Wanham is furious that school authorities did not call her before they questioned her son, and she worries that the answers he gave to school administrators could come back to haunt him. At 17, if charged with a crime, he could be tried as an adult.

A graffiti crime?

So not only are we interrogating "terrorists," we are INTERROGATING STUDENTS, too!!!

"School administrators are taking a police role or allowing police to watch my child get interrogated by school administrators, which would be evidentiary," Wanham said.

The episode in Everett is the latest example of what some say is a growing conflict between administrators' goals of running safe schools and students' legal rights. The American Civil Liberties Union of Massachusetts has launched a survey of school policies across the state.

Many school districts and local police departments have adopted guidelines that explain each agency's jurisdiction and how various incidents in the schools will be handled. But the policies tend to vary widely, including the portions that detail how, when, or even whether parents will be notified if their child is questioned by school officials with law enforcement present.

"I get calls from parents all the time about this type of issue," said Amy Reichbach, an attorney with the American Civil Liberties Union of Massachusetts.

Reichbach, a former high school teacher, is studying whether the increase in school resource officers has led to more arrests of students, especially for what she calls "stupid stuff, such as disorderly conduct." Reichbach said anecdotal reports suggest there is an increasing number of such arrests.

Go to school, get interrogated and ARRESTED!!!

But school administrators say the complex issues they face, often involving fractured families, make it increasingly difficult to balance school safety with students' legal rights.

"I have been in situations where the parents come in and they start whaling on the kid," said Haverhill's school superintendent, Raleigh Buchanan.

"There are a lot of kids who don't have parents who would show up; they don't care," Buchanan said. "If I called a lot of parents, they [would] say, 'Well, they got themselves in trouble; let them take care of it.' "

Haverhill's year-old policy gives school authorities discretion in deciding which events would trigger a call to police, but it does require that parents be notified when police are called, Buchanan said.

Some school districts, such as Peabody, have no policy governing the use of police in schools.

"If we err, we are going to err on the side of school safety," said Superintendent C. Milton Burnett of Peabody, who has been talking to the city's police chief about developing guidelines.

Peabody officials are still sorting through a December incident involving a fifth-grader who drew a picture in art class of an Internet game figure wearing a timer on his belt and a cartoon bubble over his head saying he had a bomb.

School officials waited a full day before calling police and the Fire Department and conducting a two-hour interrogation of the 10-year-old without a parent present, said the boy's mother, Maria Erenburg. No bomb was found, but the boy was suspended for two days.

"My son told me from the principal's office there was a huge glass window, and he saw his father being pushed back by police," Erenburg said.

Burnett declined to elaborate on the case, but said a parent was present. He also said school officials took stringent precautions because of "multiple bomb threats" on the Internet that month involving Massachusetts schools.

The question of balancing school safety with students' legal rights has increasingly been raised and not definitively answered, said Glenn Koocher, executive director of the Massachusetts Association of School Committees.

Apparently, children have fewer rights than "terrorists," huh?


"If there is an incident on a Saturday night and you are picked up by police, you may know you are free to go, but if [the questioning] is in the principal's office, you may not realize that," Koocher said.

Yeah, intimidation of children usually works pretty good!


Courts generally do not consider questioning by a school official to be the same as questioning by police. That distinction has allowed school administrators, often in the presence of school-based law enforcement officials, to question students without the protections of Miranda warnings, said the ACLU's Reichbach.

In the recent Everett incident, Quentin Wanham was summoned to a principal's office, with a school resource officer present, and asked by a school administrator about the logo on his pants. Everett police later announced they charged another 17-year-old with 37 counts of tagging in connection with a rash of graffiti in the city.

This is what our tax dollars are paying for?

Everett public schools' guidelines detail more than a dozen instances when student actions, such as hazing or weapons possession, must be reported to police and by whom. The last page states that when appropriate, parents will also be notified.

Yeah, you shouldn't have anything to do with your kid at school, parents.

It does not explain what constitutes appropriate. The policy also does not address whether police will be present when students are questioned by school officials.

"A police officer present can protect the child," said Louis Baldi, principal of Everett High. "If a child says, 'I am going to admit to something,' the police officer can say, 'You need a lawyer, and I am going to call your parents.' We want to make sure [students'] rights are protected, and our school resource officer is very good at that. It's not like an interrogation. Its an attempt to help the child.""
